Acceptable Use Policy

This Acceptable Use Policy (“AUP”) applies to all use of the MobileSasa CSP Platform and is incorporated by reference into the Terms of Service. It exists to protect the integrity of our carrier relationships, our CSP licence, and all Subscribers on the shared infrastructure.

Violations may result in immediate suspension of your account without refund.

1. Permitted Uses

The Platform may be used for lawful messaging purposes, including:

  • Transactional SMS — OTPs, alerts, receipts, account notifications.
  • Bulk marketing SMS to recipients who have given prior written consent.
  • USSD menus for customer self-service, surveys, and mobile money integration.
  • Inbound keyword handling and opt-in / opt-out management.
  • Campaign messaging to opted-in contact lists.
  • API-driven messaging from your own licensed or consented communication services.

2. Prohibited Content

You must not transmit messages that:

  • Are unsolicited commercial communications to recipients who have not opted in (spam).
  • Contain false, misleading, or deceptive content including phishing or smishing.
  • Impersonate a government agency, financial institution, or other organisation.
  • Promote illegal products or services under Kenyan law.
  • Contain adult content sent to minors.
  • Contain hate speech, harassment, or content that incites violence or discrimination.
  • Promote pyramid schemes, multi-level marketing without CA approval, or fraudulent investment schemes.
  • Contain malware, viruses, or any code designed to damage or disrupt systems.

3. Carrier and Regulatory Requirements

All messaging traffic on the Platform must comply with:

  • The Kenya Information and Communications Act (Cap 411A) and all regulations made thereunder, including the Kenya Information and Communications (Consumer Protection) Regulations.
  • Communications Authority of Kenya directives and guidelines applicable to Content Service Providers.
  • Each carrier's terms of service and messaging policies (Safaricom, Airtel, Telkom, Equitel, Africa's Talking).
  • Industry standards for opt-in, opt-out, and complaint handling.

Subscribers are responsible for ensuring their messages meet the content requirements of each carrier whose network the message traverses.

4. Opt-In and Consent Requirements

All promotional and marketing messages must be sent only to recipients who have given explicit prior consent. You must be able to demonstrate consent upon request. Consent must:

  • Be freely given, specific, informed, and unambiguous.
  • Include a clear description of the type of communications to be received.
  • Be recorded with a timestamp and the mechanism by which it was obtained.

Every promotional message must include a clear opt-out instruction (e.g., “Reply STOP to unsubscribe”). Opt-outs must be honoured within one business day. The Platform's built-in blacklist tool must be used to suppress opted-out numbers.

5. Rate Limits and Fair Use

To protect platform stability for all Subscribers, the following fair-use limits apply. Sustained traffic exceeding these rates may be throttled without notice:

Higher throughput requirements for the Enterprise plan should be discussed with our team in advance.

6. Security Obligations

You must:

  • Keep your API credentials, SMPP passwords, and platform login credentials confidential.
  • Not share account access with unauthorised persons.
  • Report suspected security incidents to [email protected] immediately.
  • Not attempt to access, probe, or disrupt the systems of other Subscribers or MobileSasa infrastructure.
  • Not reverse-engineer, decompile, or attempt to extract source code from the Platform.

7. Reporting Violations

To report a violation of this AUP, email [email protected] with details of the offending Subscriber and a description of the violation. We investigate all credible reports and take appropriate action.

8. Enforcement

MobileSasa may take any of the following actions in response to an AUP violation:

  • Issue a written warning.
  • Throttle or block specific message flows.
  • Immediately suspend your account pending investigation.
  • Permanently terminate your account without refund.
  • Report the violation to the Communications Authority of Kenya or other regulators.
  • Take legal action where the violation causes damage to MobileSasa or third parties.

9. Changes to This Policy

We may update this AUP at any time to reflect changes in regulatory requirements or carrier policies. Significant changes will be communicated by email. Continued use of the Platform constitutes acceptance.
